Care Proceedings

Care Proceedings, also known as Public Law Proceedings are applications made to the court, usually by a Local Authority concerning the welfare of a child.

These Proceedings are commonly issued after Social Services involvement along with other professionals to resolve concerns over a child’s welfare.

A Local Authority would have to prove to a court that there is clear evidence that the child’s welfare is at risk before they could remove a child from their primary carer.

Proceedings are likely to take 26 weeks to conclude and involve complex legal arguments and therefore it is essential that you are provided with the best possible advice and assistance.

Under the new Public Law outline, Social Services are required to undertake assessment prior to commencing proceedings and therefore it is vital that if you receive communication from the Local Authority inviting you to a Legal Planning Meeting or Child Protection Conference that you contact us immediately to provide expert advice and assistance.

Free Legal Aid is available to all parents, children and parties joined in care proceedings.
